TERMS & CONDITIONS
Welcome to RideOutTheStorm.com. RideOutTheStorm.com provides its services to you subject to the following conditions. Please read them carefully. If you visit RideOutTheStorm.com or shop at RideOutTheStorm.com, you accept these conditions.

SHIPPING & DELIVERY
We are dedicated to shipping all orders within 2 - 5 days of receipt. Orders will be sent via UPS or freight shipping with a return address of "Fulfillment Warehouse."

RETURNS & REFUNDS
Returns are accepted within 25 days from the time the order is placed as long as the products are returned in the same re-sellable condition deemed by us. All shortages must be reported within 25 days as well. If the item(s) is defective, we will replace the item and pay for the return shipping. Only the item will be replaced; not the entire survival kit.  Should you notice or have any discrepancy in your billing/invoicing you have 25 days to report it to RideOutTheStorm.
If UPS damages an item during the shipment, it is the customer’s responsibility to contact UPS directly. Insurance is issued free up to $100 but insurance must be paid for in advance if the customer wants insurance over $100. If an order is placed in error, the product total will be refunded once the products have been returned but the shipping charge as well as the return shipping cost will not be refunded. Food and water products cannot be returned to be re-sold according to law, therefore refunds for food and water products will not be issued.
For orders returned for any reason other than defective merchandise: the shipping charges will not be refunded and there will be a restocking fee of up to 25% of the original charge of the order.
Any order placed on a credit/debit card that is canceled before it ships out will have a 7% cancellation fee deducted from the refund.  If the order has shipped before we were able to cancel it, then the return policy mentioned above will be applied.

COMMUNICATING WITH US
When you visit RideOutTheStorm.com, send emails to us, or chat with us using our instant messaging service, you are communicating with us electronically. You hereby consent to receive communications from us electronically. We will communicate with you by email, through our instant messaging service, or by posting notices on this site. You hereby agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement (if any) that such communications be made to you in writing.

YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use RideOutTheStorm.com only with involvement of a parent or guardian. RideOutTheStorm reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

By registering for an account you certify that you have the right to bind to these Terms and certify that all information provided in the registration process is accurate and correct. If registering on the behalf of a company, you certify that you are a representative of your company with the right to act on their behalf.

Your user name and password are unique to you/your company and you are responsible for maintaining the confidentiality of your username, password and access to your account. You are solely responsible for any and all activities that occur under your user name and password and agree to notify RideOutTheStorm.com immediately upon any unauthorized use of your username, password or account or any other breach of security. RideOutTheStorm.com will not be liable for any loss that you may incur as a result of unauthorized use of your username, password, or account, either with or without your knowledge. However, you could possibly be held liable for losses we incur as a result of the misuse of your username, password or account.

PRODUCT IMAGES/DESCRIPTIONS
RideOutTheStorm attempts to be as accurate as possible in our product images and/or descriptions; however, RideOutTheStorm does not warrant that product images, descriptions or other content on this site are completely current or error-free. If a product offered by RideOutTheStorm is not as described, your sole remedy is to return it in unused condition.

MERCHANDISE PRICING
Except where noted otherwise, the “Price” displayed for products on our website represents the full retail price for the product itself, as suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The “Price” is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the “Price” may represent the aggregate of the manufacturer's estimated or suggested retail price for each of the items included in the set.

RideOutTheStorm cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items on our website may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. If an item’s correct price is lower than our stated price, you will only be charged the correct, lower amount.

GOVERNING LAW

DISPUTE RESOLUTION
Any dispute relating in any way to your visit to RideOutTheStorm.com or to products you purchase through RideOutTheStorm shall be submitted to confidential arbitration in Dallas, Texas, except that, to the extent you have in any manner violated or threatened to violate RideOutTheStorm’s intellectual property rights, RideOutTheStorm may seek injunctive or other appropriate relief in any state or federal court in the State of Texas, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under these Conditions of Use shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the full extent permitted by applicable law, no arbitration under these Conditions of Use shall be joined to an arbitration involving any other party subject to these Conditions of Use, whether through class arbitration proceedings or otherwise.
